New Zealand vape retailer fined over repeated under-18 sales
New Zealand’s Ministry of Health says a specialist vape retailer was fined after controlled purchase operations found repeated under-18 access and sales.

New Zealand’s Ministry of Health has reported a $35,000 fine against Discount Mall Vape Ltd after enforcement work found repeated breaches involving young people. The 5 October announcement said the case followed joint action by Health New Zealand and the Ministry of Health, including controlled purchase operations across the retailer’s branches.
The ministry described it as the first prosecution of a Specialist Vape Retailer for both selling vapes to under-18s and failing to take all practicable steps to prevent a young person entering its premises. It also said there had been ten recorded instances where a young person was able to enter a store, with six of those visits resulting in a vape purchase.
Why UK readers should note it
The case does not change UK law, but it lands in a policy area that is also tightening here. Current UK guidance says that from 29 October 2026 it will be an offence for retailers, including online retailers, to sell any vaping product or nicotine product to anyone under 18. The same guidance also covers proxy purchasing, meaning adults buying or attempting to buy these products for someone underage.
For adults who smoke or already vape, the useful distinction is between access for adults and prevention of youth use. NHS guidance continues to frame nicotine vaping as less harmful than smoking for adult smokers, while also stating that children and non-smokers should not vape.
Evidence limits
This is an enforcement announcement from public agencies, not a court transcript or independent audit of the retailer’s systems. The public facts available are the fine, the regulator’s account of the controlled purchase operations and the broader compliance figures reported by the ministry. It should not be read as evidence about product safety or adult quitting outcomes.
